Preamble — Identification and Transparency
These Legal Notices identify the publisher, the publication director, and the main technical service providers of the Fraquane digital ecosystem.
They apply in particular to the portal ps.fr, the store shop.ps.fr, the client space account.ps.fr, and the domains operated by Fraquane that provide access to its universes, pages, collections, or services.
They are established in accordance with French rules applicable to online public communication services, including loi n° 2004-575 du 21 juin 2004 for trust in the digital economy, known as LCEN.

The phone number must correspond to a professionally reachable number and be entered in the theme editor before publication.
Article 2 — Publication Director
The publication director is Orlando SEGOND-RAYNAUD, as the legal representative of Fraquane SAS.
They assume editorial responsibility within the limits provided by applicable regulations, without prejudice to rules specific to content published by third parties.

Article 4 — Hosting and Technical Platform
The store and certain services are provided via the Shopify platform. The contractual entity and hosting contact details must be verified in the active Shopify contract of Fraquane.

Fields are provided in the Shopify section to allow Fraquane to maintain accurate information. The host's phone number is mandatory and must not be replaced by an invented number.
Article 5 — Distributed Infrastructure
The ecosystem can use a content delivery network, domain name services, security, caching, payment, messaging, or authentication services that are separate from the main host.
These technical providers do not acquire the status of content publisher. Their involvement, responsibility, and any data processing are governed by their contracts and applicable policies.
Article 6 — Access to the Site
Fraquane strives to ensure the accessibility of its services, but does not guarantee continuous operation, error-free functionality, or compatibility with all devices.
Access may be suspended for maintenance, security, updates, incidents, overloads, intervention by a service provider, or force majeure. Fraquane makes reasonable efforts to limit foreseeable interruptions.
Article 7 — Nature of Published Information
The content presents the ecosystem, products, services, features, commitments, and legal information of Fraquane. They are provided for informational purposes, except when they constitute a contractual offer or mandatory pre-contractual information.
The characteristics, prices, availability, and conditions applicable to an order are those displayed in the sales process and specified in the General Terms and Conditions of Sale.
Article 8 — Accuracy and Updates
Fraquane takes reasonable care regarding the accuracy of the information published. However, errors, omissions, technical developments, or changes from a provider may occur.
Cleary incorrect information should not be used in bad faith. Any anomaly can be reported to support@ps.fr to allow for verification and correction.
Article 9 — Intellectual Property of Fraquane
The structure, design, texts, logos, distinctive signs, illustrations, photographs, videos, animations, sounds, databases, graphic elements, codes, and original content belonging to Fraquane are protected by applicable intellectual property rights.
Unless authorized in writing or permitted by law, any reproduction, representation, adaptation, substantial extraction, distribution, commercialization, or exploitation is prohibited.
Article 10 — Trademarks and Distinctive Signs
The names Fraquane, "Au-delà du jeu", the logos, emblems, visual universes, service names, and domain names used by Fraquane may constitute trademarks, trade names, signs, or protected symbols.
No license is granted by mere consultation. Any use likely to create confusion, suggest a non-existent partnership, or harm the reputation of Fraquane is prohibited.
Article 11 — Third-Party Trademarks and Content
Trademarks, games, consoles, studios, clubs, manufacturers, products, images, or works of third parties remain the property of their respective holders.
Their presence may serve to identify a compatible product, a category, news, or a commercial universe. It does not imply any affiliation, endorsement, license, or official partnership, except as expressly and verifiably indicated.
Article 12 — Authentic Products and Supplier Information
Information related to products may come from manufacturers, distributors, suppliers, or partners. Fraquane adapts and controls them to a reasonably possible extent.
Legal guarantees, information obligations, and consumer rights are not limited by the fact that initial content comes from a third party.
Article 13 — Consultation License
Fraquane grants the User a personal, limited, non-exclusive, revocable, and non-transferable license to view pages and use features for their legitimate needs.
This license does not allow automated extraction, resale of data, mass copying of the catalog, creation of a competing service, or bypassing technical protections.
Article 14 — Incoming Hyperlinks
Creating a simple link to a public page is generally allowed if it does not infringe Fraquane’s rights, mislead the public, or integrate the content in a way that makes it appear to belong to a third party.
Fraquane may request the removal of a link used in an illegal, misleading, parasitic, defamatory, or harmful context.
Article 15 — Links to Third-Party Sites
Pages may contain links to third-party services, social networks, manufacturers, carriers, payment methods, or partners.
Fraquane does not continuously control their content or practices. Users must consult their terms and policies. The presence of a link does not constitute a general guarantee or endorsement of the entire third-party service.
Article 16 — User-Published Content
When a space allows a review, comment, message, or other content, the User remains responsible for what they post and must comply with the law, third-party rights, and platform rules.
Fraquane may moderate, hide, or remove content that is manifestly illegal, fraudulent, insulting, infringing, misleading, unauthorized advertising, or contains personal data exposed unnecessarily.
Article 17 — Reporting Illegal Content
A report can be sent to support@ps.fr. To allow for proper handling, it must identify the content, its exact address, the legal reasons, the date of observation, the identity and contact details of the requester, as well as any relevant supporting documents.
Abusive, incomplete, or manifestly unfounded notifications may not lead to a removal. Fraquane may forward a request to the competent authorities or service providers when required by law.
Article 18 — Cybersecurity
It is prohibited to disrupt services, introduce malicious code, bypass authentication, test a vulnerability without authorization, extract data, overload infrastructures, or impersonate a third party.
A security flaw discovered in good faith must be reported confidentially to support@ps.fr, without exploitation, premature public disclosure, or excessive access to data.
Article 19 — User Responsibility
The User must protect their identifiers, verify the accuracy of the information provided, and use the services in accordance with the law and contractual documents.
They are responsible for the direct consequences of their illegal acts, for compromise resulting from their negligence, or for fraudulent use they themselves carry out, subject to applicable mandatory rules.
Article 20 — Limitation of Liability
Fraquane is only liable for damages that are legally attributable to it. It cannot be held responsible for damage resulting exclusively from a third party, misuse, unreported incompatibility, an external network, or an irresistible and unforeseeable event.
No clause limits legal warranties, liability for gross or fraudulent faults, bodily harm, nor rights that a consumer cannot waive.
Article 21 — Force Majeure and External Events
Fraquane is not responsible for non-performance caused by an event meeting the legal criteria of force majeure. Temporary disruptions may also be caused by general outages, major cyberattacks, operator failures, disasters, conflicts, administrative decisions, or critical infrastructure breakdowns.
Fraquane implements reasonable measures to limit the effects and restore its services.
Article 22 — Personal Data
Fraquane processes personal data to manage accounts, orders, payments, deliveries, requests, security, legal obligations, and, depending on choices, communications or personalization.
The purposes, legal bases, recipients, retention periods, transfers, and rights are detailed in the Privacy Policy. Requests may be sent to support@ps.fr.
Article 23 — Cookies and Trackers
Strictly necessary trackers may be used without consent for the cart, session, security, language, or essential preferences.
Non-essential trackers are subject to consent when required. The User may accept, refuse, or modify their choices using the manager provided for this purpose. Details are provided in the Cookie Policy.
Article 24 — Separate Contractual Documents
The Legal Notice identifies the site actors but does not replace:
- the General Terms of Sale;
- the General Terms of Use;
- the General Service Conditions when applicable;
- the Privacy Policy;
- the Cookie Policy;
- the delivery, return, and refund policies.
Each document retains its own purpose and must remain accessible separately.
Article 25 — Consumer Mediation
Information regarding the consumer mediator actually appointed by Fraquane is included in the General Terms of Sale and in the legally required documents.
No organization should be presented as a mediator without a valid agreement concluded with Fraquane.
Article 26 — Applicable Law
The Legal Notice is governed by French law. This provision does not deprive a consumer of the more protective mandatory provisions of their country of residence when applicable.
Any dispute follows the jurisdiction rules provided by law and the relevant contractual documents.
Article 27 — International Accessibility
The ecosystem is offered in several languages and on multiple domains. Content may be adapted to a country, language, currency, or category without changing the publisher's identity.
The French version of the Legal Notice constitutes the reference version, subject to mandatory rules. An unknown locale must display the English version and never automatically revert to French.
Article 28 — Updating the Legal Notice
Fraquane may update this information to reflect changes in its capital, headquarters, management, contact details, hosting provider, infrastructure, applicable law, or digital organization.
The update date appears at the top of the page. Mandatory information must be corrected without unreasonable delay after its official change.

Appendix — Mandatory Verification Before Publication
Before any publication, Fraquane must verify:
- that Fraquane's professional phone number is accurate, active, and provided;
- that the entity Shopify listed in the contract is indeed the host or service provider to declare;
- that the host’s name, address, and phone number are complete;
- that the publishing director corresponds to the current legal representative;
- that the capital, registered office, RCS, SIREN, SIRET, and VAT number are up to date;
- that the links to each legal policy function in all 20 languages;
- that the information is accessible from the footer on computer, tablet, and mobile;
- that changes to applications, domains, or infrastructure have not rendered any mention inaccurate.
Mandatory fields that have not been verified must never be replaced with invented information.
